Welcome to Delbert Lee Powers. These terms and conditions govern your use of our website and all services provided by Delbert Lee Powers, including letterpress printing, custom bookbinding, workshops, and purchases of fine press items. By engaging with our services, you agree to comply with and be bound by the following terms. Please review them carefully.

1. Orders & Payments

For all custom letterpress and book art projects, a detailed quote will be provided based on the specifications discussed. A non-refundable deposit, typically 50% of the total project cost, is required to commence work. Final payment is due upon project completion and before shipping or pickup. We accept major credit cards and bank transfers. All prices are stated in USD.

  • Quotes: Valid for 30 days from the issue date.
  • Deposits: 50% non-refundable deposit required for custom orders to initiate design and material sourcing.
  • Balance: Due upon completion and prior to delivery.
  • Accepted Methods: Visa, MasterCard, American Express, Bank Transfer.

2. Design & Proofing

Delbert Lee Powers provides digital proofs for your review and approval. It is the client's responsibility to meticulously check all spellings, grammar, dates, phone numbers, and design elements. Once approved, the client assumes full responsibility for any errors. Additional revisions beyond the initial agreed-upon rounds may incur extra charges. We strive for color accuracy but cannot guarantee exact color matching from screen to print due to inherent variations in monitors and the unique nature of letterpress inks.

  • Digital Proofs: Provided for all custom work.
  • Client Approval: Required before production begins. Client is responsible for all approved content.
  • Revisions: Typically 1-2 rounds of revisions are included; additional changes may be billed hourly.
  • Color Matching: While we aim for close matches, slight variations in color may occur between screen and actual letterpress print.

3. Shipping & Delivery

Products are shipped via reputable carriers such as USPS or UPS, unless otherwise agreed upon. Shipping costs are additional and will be included in your final invoice. Delbert Lee Powers is not responsible for delays caused by the shipping carrier or for items lost or damaged in transit once they have left our studio. We recommend insuring valuable shipments.

  • Carriers: USPS, UPS (standard), or client-specified alternative.
  • Costs: Calculated based on weight, dimensions, and destination, then added to the final invoice.
  • Turnaround: Production timelines vary; shipping times are additional.
  • Liability: Risk of loss transfers to the client upon shipment. Insurance highly recommended for higher value items.

4. Returns & Refunds

Due to the custom nature of our letterpress prints, hand-bound journals, and fine press books, all sales for bespoke or personalized items are final and non-refundable. For ready-made products, returns may be accepted within 14 days of receipt if the item is in its original, unused condition. Please contact us prior to returning any ready-made items. Approved refunds for ready-made products will exclude original shipping costs and may be subject to a restocking fee.

  • Custom Items: All sales are final; no refunds or returns.
  • Ready-Made Items: 14-day return window from receipt, must be in original condition.
  • Process: Contact us for return authorization BEFORE shipping.
  • Refunds: Processed after inspection, excluding shipping costs and potential restocking fees.

5. Workshop Policies

Registration for bookbinding or letterpress workshops requires full payment at the time of booking to secure your spot. Cancellations made 14 days or more before the workshop date will receive a full refund. Cancellations within 7-13 days will receive a 50% refund. No refunds will be issued for cancellations made less than 7 days prior to the workshop or for no-shows. In the rare event Delbert Lee Powers must cancel a workshop, participants will receive a full refund or the option to reschedule.

  • Payment: Full payment due upon registration.
  • 14+ Days Notice: Full refund.
  • 7-13 Days Notice: 50% refund.
  • Less than 7 Days / No-show: No refund.
  • Company Cancellation: Full refund or reschedule option.

6. Intellectual Property

All designs, artwork, and creative concepts developed by Delbert Lee Powers for custom projects remain the intellectual property of Delbert Lee Powers. The client receives a license to use the final printed product for its intended purpose. Reproduction or use of these designs for other purposes without express written consent from Delbert Lee Powers is prohibited. Clients warrant that any materials provided for use in custom projects (e.g., text, logos) do not infringe upon the intellectual property rights of others.

  • Ownership: All design concepts and art created by Delbert Lee Powers remain our intellectual property.
  • Client Use: Limited to the final printed product for its intended purpose.
  • Prohibitions: Unauthorized reproduction or repurposing of designs.
  • Client Warranties: Client affirms all provided materials are free from IP infringement.

7. Limitation of Liability

In no event shall Delbert Lee Powers, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose. Your use of our services is at your sole risk.
